Write down the athlete’s age, whether UIL eligibility remains in the relevant sport, and whether the proposed agreement is with a postsecondary institution or a third party. These facts are more useful than a general “Is NIL allowed?” question.
UIL’s published guidance distinguishes institution agreements for prospective college athletes age 17 or older, restrictions for those 16 or younger and family members, and execution of other agreements after applicable UIL eligibility is exhausted. It also says UIL rules do not prohibit obtaining professional representation for NIL matters. Those distinctions do not make every proposed deal permissible.

2026 Texas High School NIL Status
Highly Restricted. Prospective collegiate student-athletes age 17 or older may enter certain NIL agreements with postsecondary institutions when permitted by applicable law and NCAA rules. Athletes age 16 or younger may not sign the covered agreements, and third-party NIL agreements generally cannot be executed until UIL eligibility in the applicable sport is exhausted.
Why Texas Is Different
Texas is not an ordinary open commercial high-school NIL state. A local-business sponsorship, third-party merchandise deal or paid endorsement that might be allowed elsewhere can create a different eligibility analysis in Texas.
