2026 Delaware High School NIL Status
Permitted. The framework appears in DIAA / 14 Delaware Administrative Code 1030 §3.4.
Important Delaware Restrictions
- Compensation cannot be contingent on specific athletic performance.
- NIL cannot be an enrollment or retention incentive.
- School marks, school-branded apparel and school facilities are restricted in compensated NIL activity.
- Certain agent agreements require notice.
- Tobacco, alcohol and gambling endorsements are restricted.
Can Delaware Athletes Sell Merchandise?
Personal NIL merchandise may be possible when it is based on the athlete’s personal identity and does not improperly use school marks or branded apparel.
